How California law affects your claim

You generally have two years. California’s deadline for most personal injury claims is two years from the date of injury. Claims against a public entity — a city, county, transit agency, or the state — require a government claim, often within six months, before suit can be filed.

Being partly at fault does not bar recovery. California follows pure comparative fault. If you were 30 percent responsible, your recovery is reduced by 30 percent rather than eliminated.

What the insurer offers first is not what the claim is worth. Early offers are made before the full medical picture exists, and they are made to people who do not yet know what their future treatment will cost.

What a case is actually worth

Nobody can responsibly quote a number early, and any firm that does is guessing. Value depends on liability, the severity and permanence of the injury, available insurance, medical expenses past and future, lost earnings and earning capacity, and how a jury in the relevant county is likely to see it.
